Terms and Conditions - Passport Applications

1. Parties
In these Terms and Conditions "The User" shall refer to the person who wishes to use the Harold Jones & Sons Cattle Movement Agency to apply for Cattle Passports electronically having met the requirements for membership and signed the Cattle Passport application form. "The Agent" shall refer to Harold Jones & Sons who shall be responsible for applying for Cattle Passports on behalf of the User.

2. Recitals
The User wishes to appoint the Agent to apply to the Ministry of Agriculture Fisheries and Foods for Cattle Passports via the British Cattle Movement Service.

3. Definitions
"MAFF": Ministry of Agriculture Fisheries and Foods
"BCMS": British Cattle Movement Service
"Fees": The remuneration payable for the Agent's services as set out in clause 9
"Keepers": any natural or legal person responsible for animals
"Holding": Agricultural holding
"Expiry Date": One year from the receipt of the appropriate fees for membership of the Cattle Movement Agency for Cattle Passport Applications.

4. Grant
The User appoints the Agent to be his agent to apply to MAFF via the BCMS for Cattle Passports for his cattle as required under the Cattle Identification Regulations 1998.

5. User's Obligation
5.1 To make prompt payment to the Agent of Fees.
5.2 To inform the Agent at the address, e-mail address or telephone notified from time to time by the Agent to the User of all cattle passports required on the approved form or in the specified format within four days of tagging of the animal and within twenty-four days of the birth of the animal while the animal is still on the holding of birth.

6. Agent's Obligation
6.1 To apply to the BCMS for a Cattle Passport for an animal as instructed by the User within seven days of tagging of that animal and within twenty-eight days of birth of the animal.
6.2 To provide weekly confirmation to the User of any Cattle Passports applied for by the User.
6.3 The User will not receive confirmations if the Agent has not received an application for Cattle Passports.

7. Termination
Membership of the Cattle Movement Agency for Cattle Passport Applications shall terminate:
7.1 If either of the parties fails to comply with any of these terms and conditions and such failure capable of remedy is not remedied within 14 days of receipt of a written notice of such failure from the other party.
7.2 On the date when the User had used up all his Cattle Passport Applications if no further payment of Fees is received before the Expiry Date.
7.3 On the Expiry Date.

8. Termination Consequences
8.1 In the event of the Agent failing to deliver the services aforesaid the User will be refunded a proportion of his membership Fee dependent on the number of Cattle Passports that have been applied for according to the rates set out in column 3 of clause 9.1.

9. Fees
9.1 The User shall pay the Agent the appropriate Fee depending on his requirements. This Fee shall cover one year's membership and allow up to the number of Cattle Passport Applications specified below:

9.2 The Fees are exclusive of VAT and the User shall pay any VAT chargeable in addition of Fees.

9.3 Unused Cattle Passport Applications will not be carried forward to the following year.

9.4 Separate membership Fees are required if the User wishes the Agent to both notify Cattle Movements and apply for Cattle Passports electronically.
